# Service Terms — Bookings by Hampshire Marketing Version 2026-10-15. Effective for new agreements accepted from 15 October 2026. ## Your agreement Hampshire Marketing Ltd (company 16832421), 15 Newtown Road, Southampton, Hampshire, SO31 9FY, provides Bookings to UK businesses. Contact support@hampshiremarketing.co.uk. You must be authorised to act for the business you register. Your accepted order, these terms, the Data Processing Agreement (DPA), Acceptable Use Policy and Support Policy form your agreement. The DPA takes priority for processing personal data; expressly agreed order variations take priority over these standard terms. We confirm your plan and access when we accept your order. These terms are separate from our agency project terms. ## Your plan and payments Your order shows the features, limits, price, billing term, platform checkout fees and any assisted setup. Prices are in GBP; no VAT is currently charged. Stripe processing fees are additional. Monthly and annual subscriptions renew at the stated interval, with annual subscriptions paid upfront. We will explain renewal price changes before they apply and allow you to cancel renewal. Cancel renewal through your plan/billing options or support. Access continues to the end of your paid period. Business purchases are not refundable merely because you change your mind or do not use the service. This does not remove remedies for incorrect charges, our failure to provide the agreed service or rights required by law. We will show the price and effective date before you accept a plan change. Failed payments may lead to restriction after notice and an opportunity to resolve the issue. Lifetime purchases are a single payment with no subscription renewal. The order identifies the plan and continuing checkout fees. Five years of support and ten years of updates run from purchase; later support and new features may require a separate purchase. New customers can purchase directly where offered. Existing Free customers remain subject to their original first-14-days upgrade eligibility; restarting Free does not reset it. Existing paid subscribers must arrange a migration rather than purchase a second plan. No public offer expiry is promised here. Lifetime access lasts for the commercial life of Bookings. If Hampshire permanently discontinues Bookings within ten years of your purchase, we will refund the unused proportion of the lifetime price you paid, calculated over the ten-year period from purchase to its tenth anniversary. The unused proportion is the part of that period remaining on the date the service permanently ends. This protection does not reduce any other remedy required by law. ## Using Bookings You may use the hosted platform and connected plugin for your business during your entitlement, within your plan. Maintain your website, compatible software and backups unless separately agreed. Authorise team access carefully, remove departed staff and report suspected unauthorised access promptly. Do not resell hosted accounts or bypass allowances. Open-source components retain their own licence rights. You supply the services your customers book. Keep descriptions, prices, availability and booking/cancellation policies accurate; fulfil bookings and handle customer disputes. Collect only necessary information, provide appropriate notices and obtain required permissions. Do not upload full card details, passwords or special-category data without a separate written agreement covering the necessary safeguards. Connect only Stripe, Google and other accounts you are authorised to use. Provider terms, approval, fees and availability apply. Disconnecting a provider does not delete records already held there. We remain responsible for our integration work; a notification alone is not proof of settled payment. ## Our service and support We provide the agreed service with reasonable care and skill and investigate and correct faults for which we are responsible. Support covers product use and fault investigation. Website work, custom development, extensive training and migration require an agreed scope and price. Included setup is limited to its agreed scope. We give reasonable notice of planned material disruption where practicable; urgent protective maintenance may occur sooner. Standard plans have no guaranteed uptime percentage, fixed response/recovery time, 24-hour support or automatic service credits. An expressly agreed service level takes precedence. We do not guarantee commercial results or another provider's availability. The Support Policy explains how to get help. ## Content, confidentiality and privacy You retain rights in your content. We use it only as needed to provide and support Bookings. We retain our product rights, subject to applicable licences. Each party protects the other's confidential information, limits disclosure to people bound to protect it, and permits legally required disclosure with notice where lawful. This excludes information already lawfully public, independently developed or lawfully received elsewhere. We process booking data under the DPA; our Privacy Notice describes our own account, billing, support and security processing. We do not gain permission to sell booking records, train general-purpose AI models on them or advertise your business. Logos, case studies and testimonials require separate recorded permission covering the content, people and channels involved. Permission may be declined or withdrawn for future use without affecting the service. We stop new use and remove material we control without undue delay, subject to lawful retention of permission evidence; independent third-party copies may remain. ## Suspension and ending the service We may proportionately restrict unlawful use, serious security risks or material breaches. Where safe, we explain the issue and allow a reasonable opportunity to correct it. Urgent protective action may precede notice. Either party may end the contract for an uncorrected material breach after written notice and a reasonable opportunity to remedy it, or an irremediable serious breach. Arrange export before your access ends. Return and deletion follow the DPA, including protected backups and lawful retention exceptions. Cancellation does not itself delete records. A billing dispute does not remove data-protection duties. Rights already accrued survive termination. ## Responsibility and disputes Nothing limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or liability that cannot lawfully be limited. Each party remains responsible for its own obligations. These terms do not impose a monetary liability cap. A party prevented from performing by an event beyond its reasonable control must explain the impact and reasonably mitigate it. This does not excuse avoidable faults or missing safeguards. If performance cannot reasonably continue, the parties will address termination and prepaid fees without removing legal remedies. Material changes are explained before taking effect and do not retrospectively remove agreed rights. We seek agreement where required; publishing new wording alone does not replace an accepted order. Contact support with your account reference, issue and requested outcome. England and Wales law and courts apply, subject to mandatory rights. Email notices do not constitute formal service of court proceedings. Neither party may transfer its obligations without the other's agreement. Subcontracting does not remove our responsibilities. No partnership or authority to bind the other is created. Unenforceable provisions do not invalidate the remainder where legally possible; delayed enforcement is not a waiver. Nothing excludes fraud claims or legally protected statements.
